1. Introduction
These Terms & Conditions ("Terms") form a binding agreement between you and Delivery Amigo ("Delivery Amigo", "we", "us", or "our"). By creating an account, subscribing to a location, or otherwise using the Delivery Amigo platform (the "Service"), you agree to these Terms. The Service connects customers ("Customers") who need a secure address for incoming packages with local retail businesses ("Partners") willing to accept and hold those packages for pickup. Delivery Amigo operates as a marketplace facilitator and is not a courier, shipper, property broker, or storage warehouse. The Service is restricted to users aged 18 and older.
2. Definitions
- Customer — a registered user who subscribes to a Partner location to receive packages there.
- Partner — a verified retail business that accepts and holds packages on behalf of Customers.
- Subscription — a monthly plan (Basic or Premium) that entitles a Customer to use a specific Partner address.
- Package — a parcel addressed to a Customer and delivered to a Partner location.
- Pickup PIN — a unique code issued to the Customer to verify identity at package collection.
- Prohibited Items — items listed in Section 4 that Customers may not route through Partner locations.
3. Accounts and Eligibility
You must provide accurate registration information and keep your login credentials secure. You are responsible for activity on your account and must notify us of suspected unauthorized access. We may suspend or terminate accounts that violate these Terms, provide inaccurate information, or engage in conduct we reasonably deem harmful to the Service, other users, or Partners.
4. Prohibited Items
Customers must not route the following through a Partner location: hazardous materials, explosives, flammable liquids, firearms or weapons, illegal drugs or controlled substances, living animals, perishable food, human remains, currency, precious metals, jewelry, or any items prohibited by applicable law or the Partner's stated policies. Partners may refuse, return, or request removal of any package reasonably believed to contain Prohibited Items. Customers agree to indemnify Delivery Amigo and the Partner against losses arising from Prohibited Items.
5. Partner Obligations
Partners agree to accept packages addressed to subscribed Customers during stated operating hours, to log each package as received in the Delivery Amigo system within 24 hours of carrier delivery, to store packages in a non-public area with reasonable security, to verify the Customer's Pickup PIN before handing over any package, and to notify Delivery Amigo promptly if their location becomes unavailable. Partners must not open, tamper with, or redirect Customer packages.
6. Customer Obligations
Customers agree to pay Subscription fees on time, to use the Partner address solely for lawful personal or business shipments, to collect packages within the pickup window, to treat Partner staff and premises with respect, and to provide a Pickup PIN at collection. Customers are responsible for any Customer-provided information (including the recipient name under which packages arrive).
7. Plans, Fees, and Overage
The Basic plan is $7.50 per month and allows up to 5 packages per month. The Premium plan is $15.00 per month and allows up to 15 packages per month. Packages received beyond your monthly limit are charged at $2 per additional package. Standard package limits are 2×2×2 ft and under 50 lbs. Packages exceeding these limits may incur an additional fee of $10–$100 per package depending on dimensions, weight, and the Partner location's handling requirements. Prices may change with 30 days' notice. Payment is processed securely by Stripe.
8. Pickup Window and Late Fees
Customers have 7 days from the date a package is logged as received by the Partner location to collect it. A $2 late fee applies for each additional 7-day window the package remains uncollected. If a package is not collected within 28 days and the Customer has not been in contact with Delivery Amigo or the Partner, the Partner may, at their discretion, dispose of the package. Customers who remain in contact with Delivery Amigo may be granted additional time at the standard $2 per 7-day rate.
9. Subscription Renewal and Cancellation
Subscriptions renew automatically each month until cancelled. You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months or unused portions of a Subscription. A Customer may hold up to 5 active Subscriptions at a time.
10. Address Disclosure
The full street address of a Partner location is revealed to a Customer only after payment for an active Subscription is confirmed. Prior to that, only the neighborhood and city are shown publicly. Customers agree not to share the Partner address with third parties except as necessary to ship legitimate packages to themselves.
11. No Insurance
Delivery Amigo does not provide, offer, arrange, or act as an agent for any insurance coverage of any kind in connection with the Service. Neither Delivery Amigo nor any Partner location is an insurer, surety, or guarantor of packages or their contents. No insurance policy, express or implied, is created by these Terms, any Subscription, or any other agreement or communication with Delivery Amigo or a Partner.
Customers acknowledge that they ship packages entirely at their own risk. If you wish to insure the contents of any shipment, you must arrange such coverage independently and directly with your carrier, a third-party insurer, or your own homeowner's, renter's, or business insurance policy. Delivery Amigo expressly disclaims any obligation to do so on your behalf.
12. Liability and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Delivery Amigo makes no warranty that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
In-Transit Packages. Delivery Amigo has no control over, and accepts no responsibility or liability whatsoever for, packages while they are in the possession, custody, or control of any carrier (including but not limited to UPS, FedEx, USPS, DHL, Amazon Logistics, or any other courier or delivery service). Any loss, damage, delay, misdelivery, mis-sorting, theft, destruction, or deterioration of a package occurring during transit — whether before arrival at a Partner location, during a re-delivery attempt, or during return transit — is solely between the Customer and the applicable carrier. Customers must address any in-transit claims directly with their carrier. Delivery Amigo is not a party to any contract of carriage and assumes no liability arising from the acts or omissions of any carrier.
Packages at Partner Locations. Delivery Amigo is a marketplace facilitator and does not take physical custody of packages at any time. Partners are independent businesses responsible for exercising reasonable care over packages in their possession. Delivery Amigo is not liable for loss, theft, damage, misdelivery, or delay of packages at or by a Partner location. Delivery Amigo does not guarantee the condition, availability, or security standards of any Partner location.
General Limitation. To the maximum extent permitted by applicable law, Delivery Amigo's total aggregate liability to any Customer or Partner arising out of or in connection with the Service shall not exceed the total Subscription fees paid by that Customer in the three (3) months immediately preceding the event giving rise to the claim. In no event shall Delivery Amigo be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including but not limited to loss of profits, loss of data, loss of goodwill, or cost of substitute services, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you to the extent prohibited by law.
14. Intellectual Property
The Delivery Amigo website, software, graphics, logos, and content are the property of Delivery Amigo and are protected by copyright and trademark law. You may not reproduce, redistribute, or create derivative works from our content without prior written permission. By submitting content (such as reviews or business listings) you grant Delivery Amigo a non-exclusive, royalty-free, worldwide license to use, display, and modify that content in connection with the Service.
15. Use of Other Users' Information
Information exchanged through the Service about other Customers or Partners may be used only for the purposes of completing package pickups and fulfilling your obligations under these Terms. You may not use such information for marketing, spam, or unsolicited commercial outreach.
16. Breach and Termination
We may limit, suspend, or terminate your account at any time if we reasonably believe you have violated these Terms, provided false information, or engaged in fraudulent or harmful conduct. You may close your account at any time by cancelling all active Subscriptions.
17. Privacy
Our Privacy Policy forms part of these Terms and explains how we collect, use, and share your information.
18. Third-Party Rights
These Terms are enforceable only by you and Delivery Amigo (and our permitted successors). No third party has rights to enforce these Terms.
19. Governing Law
These Terms are governed by the laws of the United States and the state in which Delivery Amigo is incorporated, without regard to conflict-of-laws principles. Disputes must be brought in the courts of that jurisdiction.
20. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on our website or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
