1. Introduction
These Terms & Conditions (the "Terms") form a binding agreement between you and Delivery Amigo ("Delivery Amigo," "we," "us," or "our"). By creating an account, subscribing to a location, or otherwise using the Delivery Amigo platform (the "Service"), you agree to these Terms.
The Service connects customers ("Customers") who need a secure address for incoming packages with local retail businesses ("Partners") willing to accept and hold those packages for pickup. Delivery Amigo operates only as a marketplace facilitator. We are not a courier, shipper, freight forwarder, property broker, or storage warehouse.
The Service is available only to users aged 18 years or older.
2. Definitions
In these Terms, the following capitalized words have the meanings set out below:
- Service — the Delivery Amigo platform, and website, through which Customers and Partners are connected.
- Customer — a registered user who holds an active Subscription to a Partner location in order to receive Packages there.
- Partner — a verified retail business that accepts and holds Packages on behalf of Customers at a verified location.
- Partner Location — is a US commercial business location with set hours and is able to store packages in a safe and secure location.
- Subscription — a recurring monthly plan (Basic or Premium) that entitles a Customer to use a specific Partner Location address.
- Package — a parcel addressed to a Customer and delivered by a carrier to a Partner Location.
- Pickup PIN — is a unique code issued to a customer, which must be presented at the subscription location to verify identity and collect the package. One Pickup PIN applies to all Packages under a single Subscription.
- Carrier — any third-party courier or delivery service (for example UPS, FedEx, USPS, DHL, or Amazon Logistics) that transports a Package.
- Prohibited Items — the categories of items, listed in Section 4, that Customers may not route to a Partner Location.
- Billing Cycle — the one-calendar-month period that begins on a Subscription's activation date and repeats on renewal.
3. Accounts and Eligibility
You are responsible for your account and agree to each of the following:
- You must be at least 18 years old to register or use the Service.
- You must provide accurate, current, and complete registration information.
- You must keep your login credentials secure and are responsible for all activity that occurs under your account.
- You must notify Delivery Amigo promptly if you suspect any unauthorized access to or use of your account.
We may suspend or terminate any account that violates these Terms, that contains inaccurate information, or that engages in conduct we reasonably consider harmful to the Service, to other users, or to Partners.
4. Prohibited Items
Customers must not route any of the following through a Partner Location:
- Hazardous materials, explosives, or flammable liquids;
- Firearms, ammunition, or weapons of any kind;
- Illegal drugs or controlled substances;
- Living animals or human remains;
- Perishable food;
- Currency, precious metals, or jewelry;
- Any item prohibited by applicable law or by the Partner's stated policies.
A Partner may refuse, return, or require removal of any Package that the Partner reasonably believes contains a Prohibited Item. Customers agree to indemnify Delivery Amigo and the Partner against any loss, claim, or expense arising from a Prohibited Item routed to a Partner Location.
5. Partner Obligations
Each Partner agrees to:
- (a) Accept Packages addressed to subscribed Customers during the Partner's stated operating hours;
- (b) Log each Package as received in the Delivery Amigo app upon receiving them;
- (c) Store Packages in a non-public area and exercise reasonable security;
- (d) Verify the Customer's Pickup PIN, and check valid government-issued photo identification where the person collecting is not the Customer, before releasing any Package;
- (e) Notify Delivery Amigo promptly if the Partner Location becomes temporarily or permanently unavailable; and
- (f) Refrain from opening, tampering with, or redirecting Customer Packages.
6. Customer Obligations
Each Customer agrees to:
- (a) Pay all Subscription fees and any applicable additional fees when due;
- (b) Use the Partner Location address solely for lawful personal or business shipments addressed to the Customer;
- (c) Provide the correct Pickup PIN at the time of Package collection;
- (d) Collect Packages within the pickup window (described in Section 9);
- (e) Treat Partner staff, premises, and other customers with respect.
Customers are responsible for any Customer-provided information, including the recipient name under which Packages arrive.
7. Authorized Pickup by a Third Party
A Customer may authorize another person to collect a Package on the Customer's behalf by sharing the Customer's Pickup PIN with that person. The correct Pickup PIN is the primary security requirement for release. The authorized person collecting the Package on Customer's behalf must also present valid government-issued photo identification before the Partner releases the Package. The Customer remains responsible for any Package collected using the Customer's Pickup PIN.
8. Plans, Fees, and Overage Charges
8.1 Subscription plans
- Basic plan: $7.50 per month, allowing up to 5 Packages per month.
- Premium plan: $15.00 per month, allowing up to 15 Packages per month.
8.2 Overage charges
Packages received beyond the monthly limit of your plan are still accepted and are charged at $2.00 per additional Package for that month.
8.3 Oversized or overweight Packages
Standard Package limits are 2 × 2 × 2 ft in size and under 50 lbs in weight. A Package that exceeds these limits may incur an additional fee of $10.00 to $100.00 per Package, depending on its dimensions, its weight, and the Partner Location's handling requirements. Customers are responsible for providing accurate size and weight details at the time of booking.
8.4 Payment
All payments are processed securely by Stripe. Delivery Amigo accepts the standard online payment methods shown at checkout, including major credit and debit cards. The available options are displayed during signup and when you update your billing details.

9. Pickup Window and Late Fees
Customers have a 7-day pickup window that begins on the date a package is logged as received by the Partner location to collect it.
If the Package is not collected within that period, a $2 late fee per Package extends that Package's holding period by an additional 7 days. The late fee applies to each individual Package, not to the Subscription as a whole, and continues to add up for each further 7-day period the Package remains uncollected.
If a Package remains uncollected for more than 28 days and the Customer has not been in contact with Delivery Amigo or the Partner, the Partner may dispose of the Package at the Partner's discretion. A Customer who stays in contact with Delivery Amigo may be granted additional holding time at the standard $2.00 per 7-day rate.
10. Subscriptions: Renewal, Changes, and Cancellation
10.1 Renewal
Subscriptions are billed monthly and renew automatically at the start of each Billing Cycle until cancelled.
10.2 Multiple Subscriptions
A Customer may hold up to 5 active Subscriptions at one time. Each Subscription corresponds to one Partner Location and has its own pickup address and unique Pickup PIN.
Accordingly, a customer may have up to 5 distinct Pickup PINs, one for each active subscription.
10.3 Plan changes
A Subscription plan cannot be changed once a Billing Cycle has started. Your current plan remains active until the end of the Billing Cycle, and any requested plan change takes effect at the start of the next Billing Cycle.
10.4 Cancellation
You may cancel a Subscription at any time from your dashboard or by emailing support@deliveryamigo.com. Cancellation takes effect at the end of the current Billing Cycle, and you may continue to use the Service until then. There is no cancellation penalty fee.
10.5 Refunds
Refunds are not issued for active or past billing periods of a Subscription, regardless of usage. This applies to cancellations made mid-cycle and to any Billing Cycle for which a renewal has already been processed.
The only circumstance where a refund may be considered is if the customer was incorrectly charged for a future billing cycle due to: (a) a verified system error, (b) a failed cancellation that was not processed despite a valid request, or (c) a duplicate charge.
11. Address Disclosure
The full street address of a Partner Location is revealed to a Customer only after payment for an active Subscription is confirmed. Before payment for an active Subscription is confirmed, only the neighborhood and city of a Partner Location are shown publicly. Customers agree not to share a Partner Location address with any third party except as necessary to ship legitimate Packages addressed to the Customer.
12. No Insurance
Delivery Amigo does not provide, offer, arrange, or act as an agent for any insurance coverage of any kind in connection with the Service. Neither Delivery Amigo nor any Partner is an insurer, surety, or guarantor of Packages or their contents. No insurance policy, express or implied, is created by these Terms, by any Subscription, or by any other communication with Delivery Amigo or a Partner.
Customers acknowledge that they ship Packages entirely at their own risk. A Customer who wishes to insure the contents of any shipment must arrange that coverage independently and directly through the Customer's Carrier, a third-party insurer, or the Customer's own homeowner's, renter's, or business insurance policy. Delivery Amigo expressly disclaims any obligation to arrange such coverage on a Customer's behalf.
13. Liability and Limitation of Liability
13.1 Service provided "as is"
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Delivery Amigo does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
13.2 Packages in transit
Delivery Amigo has no control over, and accepts no responsibility or liability for, Packages while they are in the possession, custody, or control of any Carrier (including but not limited to UPS, FedEx, USPS, DHL, Amazon Logistics, or any other courier or delivery service). Any loss, damage, delay, misdelivery, mis-sorting, theft, destruction, or deterioration of a Package that occurs during transit (whether before arrival at a Partner Location, during a re-delivery attempt, or during return transit) is solely a matter between the Customer and the applicable Carrier. Customers must bring any in-transit claim directly to their Carrier. Delivery Amigo is not a party to any contract of carriage and assumes no liability arising from the acts or omissions of any Carrier.
13.3 Packages at Partner Locations
Delivery Amigo is a marketplace facilitator and does not take physical custody of Packages at any time. Partners are independent businesses responsible for exercising reasonable care over Packages in their possession. Delivery Amigo is not liable for the loss, theft, damage, misdelivery, or delay of Packages at or by a Partner Location, and does not guarantee the condition, availability, or security standards of any Partner Location.
13.4 General limitation
To the maximum extent permitted by applicable law, Delivery Amigo's total aggregate liability to any Customer or Partner arising out of or in connection with the Service shall not exceed the total Subscription fees paid by that Customer in the three (3) months immediately preceding the event giving rise to the claim. In no event shall Delivery Amigo be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, loss of data, loss of goodwill, or cost of substitute services, even if advised of the possibility of such damages. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you to the extent prohibited by law.
14. Intellectual Property
The Delivery Amigo website, software, graphics, logos, and content are the property of Delivery Amigo and are protected by copyright and trademark law. You may not reproduce, redistribute, or create derivative works from our content without our prior written permission. By submitting content (such as reviews or business listings), you grant Delivery Amigo a non-exclusive, royalty-free, worldwide license to use, display, and modify that content in connection with the Service.
15. Use of Other Users' Information
Information you obtain through the Service about other Customers or Partners may be used only to complete Package pickups and to fulfill your obligations under these Terms. You may not use such information for marketing, spam, or any unsolicited commercial outreach.
16. Privacy
Our Privacy Policy forms part of these Terms and explains how we collect, use, and share your information.
17. Suspension and Termination
We may limit, suspend, or terminate your account at any time if we reasonably believe you have violated these Terms, provided false information, or engaged in fraudulent or harmful conduct. You may close your account at any time by cancelling all active Subscriptions.
18. Third-Party Rights
These Terms are enforceable only by you and Delivery Amigo (and our permitted successors). No other person or entity has any right to enforce these Terms.
19. Governing Law
These Terms are governed by the laws of the United States and of the state in which Delivery Amigo is incorporated, without regard to conflict-of-laws principles. Any dispute must be brought in the courts of that jurisdiction.
20. Changes to these Terms
We may update these Terms from time to time. We will announce material changes on our website or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
