This Privacy Policy (the "Policy") is incorporated into the Terms of Delivery Amigo ("we," "us," "our") and uses the same defined terms (such as Service, Customer, Partner, Partner Location, Subscription, Package, and Pickup PIN). Please read this Policy carefully before using the Service. If you have questions, contact us at support@deliveryamigo.com before proceeding.
1. Information We Collect
1.1 Account and Registration Information
When you register as a Customer or Partner, we collect the information you provide, such as your name, email address, phone number, business name (for Partners), and password. Partners also provide a business address, operating hours, and bank-payout details. Customers provide a billing email and the recipient name under which Packages will arrive.
1.2 Subscription and Package Information
We store records of your Subscriptions, the Partner Location you chose, Packages logged by the Partner (recipient name, arrival date, pickup date, and status), Pickup PIN hashes, and any late-fee or overage events. Payment details are processed by Stripe; we do not store full card numbers on our servers.
1.3 Cookies and Local Storage
We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Service is used. You may disable cookies in your browser, but some parts of the Service (such as sign-in and checkout) will not function without them.
1.4 Device and Log Data
Our servers automatically record information your browser transmits, including IP address, browser type and version, language, operating system, referring URLs, and timestamps. This data helps us operate, secure, and improve the Service.
1.5 Communications
We retain emails, support tickets, and in-app messages you send to us or to Partners in order to maintain service records, resolve disputes, and improve quality. Where legally required, we obtain consent before recording voice calls.
1.6 Reviews and User-Generated Content
If you submit a review of a Partner Location, we collect the content of the review and the name you choose to display. Reviews are public once approved.
2. How We Use Your Information
We use the information described above to:
- create and operate your account, process Subscriptions, and deliver the Service;
- communicate with you about bookings, Packages, late fees, and account activity;
- prevent fraud, abuse, and security incidents;
- comply with our legal obligations;
- improve product quality, monitor performance, and develop new features; and
- send service announcements and, with your consent, marketing communications that you can opt out of at any time.
3. Your Choices
You may review and update most account information from your dashboard. If you wish to correct, export, or delete personal data we hold about you, contact support@deliveryamigo.com. Some information (for example, transaction records) must be retained for tax and legal compliance.
If we wish to use your information for a materially new purpose not described in this Policy, we will ask your permission before doing so. You may decline, although this may limit functionality.
4. When We Share Information
We share personal data with third parties only in the following circumstances:
4.1 With Partners to Fulfill Bookings
When you subscribe to a Partner Location, we share the necessary information (recipient name, Subscription status, and Pickup PIN verification) with the Partner so they can accept and hand over your Packages. Partners agree to use this information only for the purpose of the Subscription.
4.2 With Service Providers
We use third-party vendors to process payments (Stripe), send transactional email (SendGrid), host infrastructure, analyze usage, and provide customer support. These vendors are bound by contract to use your information only to provide services to us.
4.3 With Your Consent
We will obtain your explicit opt-in before sharing sensitive information with third parties for any purpose not described in this Policy.
4.4 For Legal and Safety Reasons
We may access, preserve, and disclose information where we reasonably believe it is necessary to: (i) comply with applicable law, legal process, or a government request; (ii) enforce our Terms; (iii) detect, prevent, or respond to fraud, security, or technical issues; or (iv) protect the rights, property, or safety of Delivery Amigo, our users, our Partners, or the public.
4.5 Business Transfers
If Delivery Amigo is involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.
4.6 Aggregated or De-identified Data
We may share aggregated or de-identified data (such as city-level demand statistics) with third parties for research, analytics, or marketing. Such data does not identify you individually. This does not constitute a "sale" or "sharing" of personal information under California law, because the data cannot reasonably be linked to you.
4.7 We Do Not Sell or Share Your Personal Information
Delivery Amigo does not sell your personal information for money, and does not share it for cross-context behavioral advertising, as those terms are defined under California law. If this practice ever changes, we will update this Policy and provide the opt-out mechanism required by law before doing so.
5. Data Retention
We retain personal information for as long as your account is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account as described in Section 3.
6. Security
We take reasonable technical and organizational measures to protect personal information, including encrypted transport (HTTPS), hashed passwords, and scoped access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
7. Children
The Service is not directed to individuals under 18, consistent with the eligibility requirement in our Terms. We do not knowingly collect personal information from children. If you believe a child has provided us with information, please contact us and we will delete it.
8. International Users
Delivery Amigo is based in the United States, and your information will be processed in the U.S. By using the Service, you consent to the transfer of your data to the U.S., which may have different data-protection laws than your country.
9. Changes to This Policy
We may amend this Policy from time to time. We will announce material changes prominently on our website or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Policy.
10. California Privacy Rights
10.1 Scope
This Section applies only if you are a California resident. In this Section, "Personal Information" has the meaning given in the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (together, the "CCPA"). This Section supplements the rest of this Policy and controls only to the extent of any conflict for California residents.
10.2 Your Rights
Subject to certain exceptions permitted by law, you have the following rights regarding your Personal Information:
- Right to know and access. You may request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business purposes for collecting it, and the categories of third parties to whom we disclose it.
- Right to delete. You may request that we delete the Personal Information we have collected from you, subject to legal exceptions (for example, information we must keep to complete a transaction, process a Subscription, comply with tax or legal obligations, or detect and prevent fraud).
- Right to correct. You may request that we correct inaccurate Personal Information we hold about you.
- Right to opt out of sale or sharing. You have the right to opt out of the "sale" or "sharing" of your Personal Information. As explained in Section 4.7, Delivery Amigo does not sell your Personal Information or share it for cross-context behavioral advertising.
- Right to limit use of sensitive personal information. You may request that we limit our use of any sensitive Personal Information to what is necessary to provide the Service.
- Right to non-discrimination. We will not discriminate against you for exercising any of these rights, we will not deny you the Service, charge you a different price, or provide a different level or quality of service because you exercised your California privacy rights.
10.3 How to Exercise Your Rights
You, or an authorized agent acting on your behalf, may submit a request by emailing support@deliveryamigo.com. To protect your information, we will take reasonable steps to verify your identity before responding, which may require you to confirm details associated with your account. We will respond within the timeframes required by law, generally within 45 days, with one extension where reasonably necessary and permitted. There is no fee to make a request unless it is excessive, repetitive, or manifestly unfounded.
10.4 Categories of Information
The categories of Personal Information we collect, the purposes for which we use them, and the parties with whom we share them are described in Sections 1, 2, and 4 of this Policy.
